The words "we," "us," and "our" refer to e-Outlet and eoutletkw.com.

1.2 Governing Law and Jurisdiction

These Terms of Service are governed by the applicable Kuwaiti laws, specifically including:

Commercial Law (68/1980)
Electronic Transactions Law (20/2014)
Consumer Protection Law (39/2014)

The Kuwaiti courts shall have exclusive jurisdiction over any dispute regarding transactions through the Site.

1.3 Scope of Application Outside the State of Kuwait

In the event of purchasing products or using the site's services from outside the State of Kuwait, the consumer rights stipulated in the laws of the customer's country of residence shall be respected, provided they do not conflict with Kuwaiti laws.

1.4 User Consent

By using the Site or completing any purchase, you agree to be fully bound by these Terms. If you do not agree to any part of the Terms, you must immediately cease using the Site.

1.5 Eligibility

The user affirms that they have reached the legal age of majority in their country and are authorized to use and make payments through the Site.

1.6 Notices and Communications

Any notice or communication related to the service, order status, or your approval of any changes (such as change in size, color, or shipping delay) is considered legally delivered and effective upon being sent through one of the following means to the user's registered data:

a. Registered Email: Official notices regarding the Terms, invoices, and cancellations.

b. Text Message (SMS): Notices of shipping status, delivery details, and order confirmations.

c. Automatic Messages via App (if applicable) or through any registered instant messaging channel (such as WhatsApp) required for order fulfillment.

User Responsibility:

The user bears full responsibility for ensuring that all registered contact data (email, phone number, and delivery address) are accurate and up-to-date. In the event of failure to deliver notices or delay in order processing due to incorrect contact information, e-Outlet assumes no responsibility for the resulting damage.

1.7 Amicable Dispute Resolution

Both parties (e-Outlet and the User) agree that any dispute arising out of or related to these Terms of Service must first be attempted to be settled amicably through direct communication and good faith between the parties for a period of not less than thirty (30) days from the date one party notifies the other in writing of the existence of the dispute, before resorting to the competent Kuwaiti courts stipulated in clause (1.2).

1.8 Amendments to the Terms

We reserve the right to modify or update the Terms at any time. Your continued use of the Site signifies your complete acceptance of any amendments posted on this page.

2. Electronic Service and Contracting

2.1 Protection of Personal Data

The data entered by the user during ordering or registration is subject to the Site's Privacy Policy. The Site is committed to implementing the provisions of the Electronic Transactions Law regarding data retention and confidentiality.

2.2 Right to Correct Order Errors

In accordance with the Electronic Transactions Law, we reserve the right to:

Correct any error in pricing or product availability.
Modify or cancel the order after notifying the customer.
Issue a full refund in case of order cancellation after payment.

The user is responsible for ensuring the accuracy of the data entered upon ordering.

2.3 Accuracy of Billing and Account Information

The user is obligated to provide correct and complete data, including:

Payment details
Delivery address

This information must be updated immediately upon any change.

2.4 Changes to Prices and Services

Prices are subject to change without prior notice. We reserve the right to modify or discontinue any of the Site's services without prior notice. We are not liable for changes in prices or service interruption to the extent permitted by law.

2.5 Taxes and Customs Fees

A. Local Pricing:

All prices displayed on the website are in Kuwaiti Dinars (KWD) and do not include Value Added Tax (VAT) or any other general sales tax, in accordance with the current legislation of the State of Kuwait which does not impose such taxes.

B. Future Obligation:

We reserve the right to immediately adjust prices to reflect any new taxes (such as VAT or others) that may be imposed in the future under the effective laws of the State of Kuwait. These adjustments will apply to all orders placed after the effective date of the new tax law.

C. International Sales:

In the event of shipping to destinations outside the State of Kuwait, the customer acknowledges and agrees that the displayed prices do not include any import taxes, customs duties, Value Added Tax (VAT), or any other fees imposed by the authorities of the destination country. The customer shall be solely responsible for paying these additional fees required to receive the shipment in their country (if applicable), and e-Outlet disclaims responsibility for any delay or confiscation of products resulting from the customer's failure to pay such fees.

3. Products and Return Policy

3.1 Guarantee of Authenticity and Quality

The Company is committed to selling original products only. In the event a product sold is discovered to be other than its original condition, the Company assumes responsibility for compensating the customer by replacing the product with another or fully refunding its value, with a commitment to full cooperation to address the complaint within 14 days from the date of receiving the order.

3.2 Return and Exchange Policy

The customer has the right to request a return or exchange within 14 days provided that the product is:

Defective
Or does not conform to specifications
Or does not serve the purpose for which it was purchased

This entails:

Full refund of the amount
Or product exchange with payment of the price difference if applicable

3.3 Out of Stock or Inventory Shortage

In the event a product runs out after the order is completed:

The customer will be contacted immediately.
Full refund or exchange is possible.
If the customer does not respond, the amount will be automatically refunded.

3.4 Delay in Pre-Orders

Pre-orders may be delayed for more than 30 days due to circumstances beyond our control. In this case:

The customer will be contacted.
The customer has the right to proceed or cancel the order with a full refund.

3.5 Shipping and Delivery

The delivery times provided by the Site are estimates only, and the delivery period starts from the date of order confirmation and payment, not from the date of completion. e-Outlet is not responsible for any delivery delay caused by third parties (including shipping companies or customs procedures) provided the Company has handed over the product to the shipping company on time. 4. General Provisions

4.1 External Tools and Links

The Site may contain links or tracking tools for third parties. The Site is not responsible for:

Their privacy practices.
Any damages resulting from their use.

The user is responsible for reviewing the terms of those sites before dealing with them.

4.2 Prohibited Uses

Any act aimed at harming the brand, misleading consumers, or unlawful defamation is considered a legitimate reason for taking the following actions:

Taking legal action according to the applicable laws in the State of Kuwait.
Suspending or terminating the user's access to the Site's services.
Claiming compensation for any material or moral damages incurred by the Company as a result of this behavior.

This clause is applied to the extent permitted by law in the State of Kuwait and does not conflict with its effective legislation.

4.5 Indemnification Clause

The user agrees to indemnify and hold harmless e-Outlet and Dow Jones General Trading Co. W.L.L., its directors, employees, agents, and suppliers from any claims, losses, damages, liabilities, or costs (including reasonable attorneys' fees) arising out of:

The user's breach of any of the Terms of Service.
Misuse of the Site or services.
Violation of any local or GCC law related to the use of the Site.
Any claim brought by a third party as a result of the user's use of the Site or content.

4.6 Limitation of Liability (Direct Compensation Only)

e-Outlet or Dow Jones General Trading Co. W.L.L. shall not be liable to the user or any third party for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenue, resulting from the use of the Site or products, even if we have been advised of the possibility of such damages. The Company's liability is in all cases limited to the actual value of the purchased product subject to the dispute.

4.7 Disclaimer of Warranties

The Site's services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

Your use of our service will be uninterrupted, timely, secure, or error-free.
The results that may be obtained from the use of the service will be accurate or reliable.
Any errors in the service or software will necessarily be corrected.

The user acknowledges that the use of the Site's services and the products offered is at their sole risk, and e-Outlet assumes no responsibility for warranties related to merchantability, fitness for a particular purpose, or non-infringement.

4.8 Acknowledgment of Original Brand Intellectual Property Rights

Authenticity of Products and Third-Party Brands: The user acknowledges, and we (e-Outlet) undertake, that all brand names, logos, service marks, and images of the luxury products offered for sale on this Site are registered trademarks and owned exclusively by their respective original owners and manufacturers.

Usage: These marks are displayed on the Site solely for the purpose of product identification, authentic source disclosure, and description.
No Affiliation or Endorsement: The use of these marks does not imply any official affiliation, partnership, agency, or direct endorsement by the original owners of those trademarks toward [e-Outlet] or Dow Jones General Trading Co. W.L.L., unless expressly stated otherwise.

4.9 User Intellectual Property Rights

The user affirms that they have the necessary rights to grant this license.

4.10 Force Majeure

e-Outlet shall not be liable for any delay or failure to perform any obligation under these Terms if such failure results from circumstances beyond our reasonable control, including, but not limited to, natural disasters, labor strikes, or interruption of public communications or transportation.

4.11 Severability

If any part or provision of these Terms of Service is determined to be unlawful, void, or unenforceable under Kuwaiti law, that part shall be deemed severed from the remainder of the Terms and shall not affect the validity and enforceability of any remaining provisions.
